General Terms and Conditions

Goods for sale at Domko.com

The subject of sale shall be the Goods offered on the Site at the time of request for purchase by the User, which are indicated to be in stock and the specified quantities available for sale.

Goods sold through the Site are described by type, quality and quantity. Domko Ltd. is not responsible for any possible differences in the colours of the purchased Goods due to the specifics of the computer screens. The application form for purchase of Goods is considered as written consent of the User regarding the type, quality and quantity of the Goods.

Delivery

Deliveries are made to the address indicated on the order. It is advisable to provide an address to which the Goods can be received from 10:30 AM to 5:30 PM (for example a business address). Upon receipt of the Goods, the delivery price specified in the order shall be paid, and when the Goods are paid by a bank transfer, the delivery price shall be included in the price of the ordered Goods.

Cancellation of an order can be made via the contact form or via e-mail.

Price

Prices of the offered goods shall be indicated individually for each type and according to colour, size, material, etc.

The price for the delivery of the Goods shall be additionally indicated in the order you make. You can see the full table of delivery times and prices on the “Transport” page on our site.

Discounts that are periodically announced by Domko Ltd. do not apply to Goods that have already been discounted due to clearance sale. Discounts shall be subject to availability - i.e. for those products with an old price that is stricken off and a new one is indicated in red.

Payment for the Goods ordered:

* Cash payment

If the customer wishes to receive the Goods which he has ordered directly from the warehouse of Domko Ltd. (145, Okolovrasten pat Str., Sofia),the Goods shall be transported by the customer. Following the steps of the order, please select “Cash” from the “Payment method” menu and “Transport by the Customer” from the “Delivery” menu. Click on “finish order”.

* Payment on delivery (cash on delivery)

You pay the amount due for the Goods to the courier. It is indicated in the price of the Order. Collection and insurance costs shall be covered by Domko.

* Paying by bank transfer

You need to make a bank transfer to the account of Domko.com. Following the steps of the Order, choose “bank transfer” from the “payment method” menu. Click on “finish order” and on the page that opens you will see the bank accounts to which you will make the transfer. The Order will be executed after receipt of the transfer. Upon delivery of the Goods you owe nothing to the courier.

* Payment with bank card (via virtual POS terminal)

To do this, it is necessary to select “bank card” from the “payment method” menu of the Order.

The bank cards accepted by us are: MasterCard, MasterCard Electronic, Maestro, Visa, Visa Electron, and V PAY

Please note that your card V PAY or MasterCard Electronic payment will be made only if it is registered in the schemes for online payments Verified by Visa or MasterCard SecureCode.

Please also check that your card is enabled for online transactions by the issuing bank.

The maximum transaction amount is BGN 10,000.00.

Safety of input and transfer of card data is made through the use of SSL protocol for encrypted communication between our server and the payment page of our bank.

- The authenticity of your card is checked by entering your card security code (CVV2);

- In addition, to ensure you as a cardholder, the payment server for e-commerce of our bank supports schemes for authentication of most world cardholder organizations: Verified by VISA and MasterCard SecureCode, if you have them to use registration.

The data that the customer must fill in for card payment are:

- Card details (number, expiration date, 3-digit security code, cardholder name, and address)

- Authentication Details (To identify yourself as a cardholder, our e-commerce payment server of our servicing bank supports the authentication schemes of international card organizations - Verified by VISA and MasterCard SecureCode. If you are registered for these schemes, a page will appear on your screen where you need to enter your authentication password.

IMPORTANT: Domko Ltd. does NOT collect card data and as a merchant we do not have access to it, but only our servicing bank.

The transaction currency (the one that is entered on the payment page upon purchase) is Bulgarian Lev.

When paying by card through a virtual POS terminal, the User deposits an amount equal to the value of the order. Goods and Services ordered shall be delivered only after the deposit transaction is confirmed. In case the User cancels in part or in full the purchased goods within one week from the date of delivery Domko.com shall refund in part or in full the amount deposited through a credit transaction to the card that made the payment. In case the User does not cancel the purchase of Goods or Services, Domko.com automatically accepts the deposit made as payment for the Goods or Services ordered.

* Payment via ePay.bg (cards Borika, EUROLINE, Maestro, MasterCard, VISA, and TBICredit)

If you have a debit or credit card, issued by a Bulgarian or international bank, you could pay through the ePay.bg system. In case of selecting this payment method, you shall be transferred to the webpage of Epay.bg, where you should enter your username and password in order to confirm the payment. Please follow all the steps to be redirected back to Domko.com and register your Order. The Order will be executed after receiving the transfer into our bank account. When you receive the Goods, you do not owe the courier anything.

* Transcard payment (Transcard Classic, Transcard Gold, JCB Transcard and MasterCard Transcard)

If you have a credit card issued by Transcard Financial Services EAD, you can pay through the Transcard.bg system. In case of selecting this payment method, you shall be transferred to the webpage of Transcard.bg, where you should enter your username and password in order to confirm the payment. Follow all the steps to be redirected back to Domko.com and to register your Order. The Order will be executed after receiving the transfer into our bank account. When you receive the Goods, you do not owe the courier anything.

* Attention! When the product concerned states that the delivery is made only after it has been prepaid, it means that the product must first be paid and then delivered, i.e. it is not possible to use the cash on delivery method for this product.

Return of Goods

Goods are subject to return if they do not meet the quality requirements given on the website and/or in their accompanying certificates, instructions for use and others, insofar as they are issued for the respective Goods, as well as those contained in the delivery of the User, are subject to return due to obvious defects /no difference in the shade of colours is considered a defect, and this cannot be a reason for returning the goods!!!/. For the purpose of delivery, the User shall note on the consignment note the existence of obvious defects and/or discrepancy in the quantity, otherwise the quantity of the Goods shall be deemed to correspond to the Order and the contract is executed correctly.

Except in cases of discrepancy in the quantities the complaints regarding the purchased and delivered Goods can be made within 14 days from the date of delivery.

According to the Consumer Protection Act of the Bulgarian legislation, purchased products online can be returned within 14 days after delivery, without any explicit reason, as long as they are in the same condition as when received (including the wrapping). Transport costs for return are borne by the Customer.

Purchase order cancellation

Dear customers, Domko Ltd. guarantees the quality of all its products. However, in the unlikely event that they do not meet your requirements, you have the right to cancel one or more items included in the placed order within 14 days of its receipt, by sending it, together with the accompanying purchase order cancellation form to our return address (written on the form) via Speedy /www.speedy.bg/ or Evropat /www.evropat.bg/.

We kindly ask you to take care of the items while in your possession and during their return, in order to avoid any damage or loss during the transportation process. Do not forget to keep the postal receipt or the document, issued by the shipping company, as proof that your shipment has been sent. Otherwise, you take the risk of losing the items before we have received them.

Please consider the following when returning an item:

• If you decide to return a cancelled item, it must be accompanied by a proof of purchase (a receipt, a shipper’s consignment note, or an invoice) and a purchase order cancellation form (it is received together with the shipment). The returned item must be unused, unpacked, with undisturbed commercial appearance, and with its undamaged original packaging, addressed to our mailing address: 145, Okolovrasten pat Str., Sofia.  If the purchase order cancellation form is not included in the shipment, please email us at e-domko@domko.com , so we can send it to you;

• For reasons of hygiene, if the packaging of certain items has been opened, such as bed linen, blankets, pillows, light blankets, towels and bathrobes they cannot be cancelled or returned, unless the customer is entitled to return them, i.e. they are faulty and we have confirmed the fault;

• Custom-made items cannot be returned or replaced, and the customer shall be responsible for the accuracy of the dimensions provided. This is not the case when a product of non-standard size is defective;

The refund of cancelled item(s) after confirmation by an employee of Domko Ltd. that the returned goods meet the criteria above is carried out in the form of the original payment method, i.e. if you paid with a debit card, then the amount will be refunded by credit transaction on the same card within 14 business days of receiving the returned goods. Upon payment by cash or bank transfer, the amount of the returned item(s) will be refunded by bank transfer to the bank account you specified.

We do not refund for items returned after 14 days of receipt, damaged, used items or items with broken packaging. In such cases, we will return the items back to you.

The cancellation policy does not violate the customer’s rights in case of defective/damaged goods.

Rights and obligations of the User

The User has the right to view, order and receive the Goods from the Site according to the terms and conditions specified therein.

The User has the right to be informed about the status of his Order.

The User has the right to be delivered the requested Goods to the specified delivery address, after confirmation by telephone, made by an operator of Domko Ltd.

The User is fully responsible for the protection of his username and password, as well as for all actions performed by him or a third party by using the username and password. The user is obliged to immediately notify Domko Ltd. and the relevant authorities of any case of unauthorized access by using his username and password, as well as whenever there is a danger of such use.

The User shall pay the price of his Order according to the method announced on the Site.

Each User, regardless of whether he has made an Order or not, should:

    * Not violate and shall respect the rights and freedoms of citizens, in accordance with the Constitution, the laws of the Republic of Bulgaria and the applicable international acts, the rules of morality, good manners and the Internet ethics;

    * Not breach property or non-property, absolute or relative rights and interests of other parties, such as property rights, intellectual property rights, etc.;

    * Not commit malicious acts.

Rights and Obligations of Domko Ltd.

Domko Ltd. has the right but not the obligation to keep materials and information used/posted on the webserver at www.domko.com or made available to third parties by the User, and to make them available to third parties and the relevant state authorities in order to observe the rights and legitimate interests, property and safety of www.domko.com, as well as to third parties, in case of claims for infringement of their rights in connection with the information or materials used or disseminated , and when the materials or information have been requested by public authorities under an express legal provision.

Domko Ltd. has the right at any time, without informing the User, when the latter uses the Site in violation of these Terms and Conditions, as well as at the discretion of Domko Ltd., to terminate the access of the User to the Site. Domko Ltd. shall not be liable to the User and third parties for any damages and loss of profit arising from the termination, suspension, modification or limitation of access, deletion, loss, inaccuracy or incompleteness of messages, materials or information, uploaded, used, recorded or made available through the Site of Domko Ltd.

Domko Ltd. may provide links to other websites and resources in the subject sections of the online store. Domko Ltd. shall not be liable for any damages or loss of benefits arising from the use, access or reliability of these materials and content. The User shall be solely responsible for all damages caused to Domko Ltd. and third parties as a result of using or accessing these websites and resources.

The User shall indemnify Domko Ltd. and all third parties for all damages and loss of profit, including any costs and attorneys’ fees arising from claims and/or paid damages to third parties in connection with the Site, hyperlinks, materials or information that the User has used, placed on the server of Domko Ltd., sent, distributed, made available to third parties or made available through Domko Ltd. in violation of the law, these General Terms and Conditions, the Good Manners or the Internet Ethics.

Domko Ltd. has the right to send a weekly newsletter to the users of the Site, if they have given their consent. This letter contains up-to-date promotions, new products, news about upcoming holidays, fresh gift ideas, etc. Domko Ltd. has no right to send letters to Users who have explicitly stated that they do not wish to receive it.

Domko Ltd. has the right to collect and use information about its Users.

The information under the previous paragraph may be used by Domko Ltd., except in the event of explicit dissent of the User, sent to the following e-mail address e-domko@domko.com. Domko Ltd. collects and uses the information to improve the supply of the Goods and to meet consumers’ needs. All purposes for which DOMKO Ltd. will use the information will be in compliance with the Bulgarian legislation, applicable international acts, good manners and Internet ethics.

Domko Ltd. guarantees to its Users the confidentiality of the information and personal data provided. The latter will not be used, made available or made known to third parties except in the cases and under the conditions set out in these General Terms and Conditions.

Domko Ltd. has the right to install cookies on the computers of the Users. These are text files that are saved from the Site on the user’s hard disk and allow the recovery of information about the User by identifying and tracking his actions, the websites he visits, the hyperlinks he uses, the information he uses and records, etc.

Personal Data Protection. Confidentiality.

Pursuant to the Personal Data Protection Act, the User has the right to access his personal data which he has entered into or made available to Domko Ltd. when using it on the Site, as well as to request correction of such personal data.

The users who have filled in the registration form and have accepted these General Terms and Conditions expressly agree that the personal data provided by them will be processed by Domko Ltd. electronically upon delivery of the ordered goods or services.

The users provide their personal data voluntarily for the purpose of their identification in the process of using the Site and it can be stored, processed and used by Domko Ltd. for the purposes of maintaining the offered services and for the purposes of advertising of goods and services offered in the retail chain of stores of DOMKO Ltd. such as receiving brochures, newsletters and other news offered by Domko Ltd.

Domko Ltd. states that personal data provided by the Users of the Site are not transferred to third parties for advertising, promotional and/or other purposes.

Domko Ltd. reserves the right to use the IP addresses and other data of the Users for revealing their identity in cases where this is necessary on the basis of a legal order of the relevant state authority, issued in due order, or for the purpose of performing legal procedures, or for the purpose of compliance to the General Terms and Conditions of the Site.

Amendment to the General Terms and Conditions

The General Terms and Conditions may be amended at any time by Domko Ltd. and the latter shall notify the User about changes in the General Terms and Conditions, by posting a message about the changes on the Site and providing the User sufficient time to become aware of such changes. If the User does not agree with the changes within the time provided, then he is considered bound by the changes. In the event that the User does not agree with the changes, Domko Ltd. shall have the right to immediately suspend or terminate the access to the Site of the respective User, and the obligations incurred up to that moment shall be fulfilled.

Notifications

Unless expressly stated otherwise, all notices related to the ordering and delivery of Goods through the Site shall be made to the telephones /contact addresses prominently displayed on the Site and respectively to the specified telephones/ and the contact address of the User, including the e-mail addresses. The User may be informed of the status of his order at any time from the “My Orders” section. The notices made in this way shall be considered duly received until proven otherwise.
