General Terms and Conditions

These terms and conditions are intended for customers ("User(s)") who use the services of the online store "www.domko.com" ("Online Store"). The E-shop is owned by "DOMKO" Ltd, with a registered office and management address. Sofia, p.k. 1700, Lozenets district, 1700 Lozenets Blvd. "02/879 12 15, 0700 420 02, registered in the Commercial Register at the Registry Agency with UIC: 130181148, registered under VAT Act BG130181148, ("DOMKO").

Users may enter into contracts for the sale of goods and services from a distance and delivery of the goods offered in the Online Store, including the following:

- To register and create a user profile in the Online Store;

- To add products to the cart in the Online Store;

- To enter into contracts for the purchase and delivery of goods remotely via the Online Shop;

- To make payments of the price of the ordered goods in accordance with the payment methods specified by DOMKO;

- To receive information about new goods, promotional offers, campaigns, and newsletters, participate in games and sweepstakes, through the Online Store;

- To view the goods, their characteristics, prices, and delivery conditions.

Any use of the online shop means that users have read the Terms and Conditions of Use and have agreed to comply with them.

All goods, including those on promotion, are sold and delivered while stocks last, during the promotion period.

The e-shop may contain links to other sites, and DOMKO is not responsible for the use of these sites when redirecting to them.

Users have the option to purchase the goods offered through the online store, and DOMKO undertakes to deliver the requested goods subject to availability, for which users are obliged to pay DOMKO the prices advertised on the online store, as well as a delivery charge in accordance with the terms set out on the online store and these General Terms and Conditions.

DOMKO shall deliver the goods ordered within the terms and conditions set out on the online shop and these General Terms and Conditions.

The goods offered in the online shop are intended for home use and are sold in quantities customary for personal consumption. In the event of any doubt that a user will purchase the goods for professional purposes and/or for the purpose of resale, DOMKO reserves the right, at its sole discretion, to refuse the order of the goods requested by that user. All statements made by DOMKO and users in connection with the ordered goods may be made as electronic statements within the meaning of the Electronic Document and Electronic Signature Act. In accordance with the E-Commerce Act, the contract statement and the acknowledgment of receipt shall be deemed to have been received when their addressees are able to access them. Using the Online Shop

Users can use the E-shop to purchase goods and services by registering a user profile by entering the following identification data: name, e-mail, telephone, full address, billing data, if different from the data entered, password, and they have the option to agree to receive an electronic newsletter.

Users can also use the services of the online shop as unregistered users by entering the same identification data required for registration.

The login to access the user profile of registered users is done via e-mail and password chosen by users.

Registered users have the option to add products to the favourites section of their profile.

All users can use a promo code, if any, available on the E-Store when generating an order to receive a discount on the goods ordered.

By completing the credentials and registering a user profile, as well as generating and completing an order, users declare that they have read and agree to these terms and conditions and the privacy policy, links to which are available on the online store.

DOMKO confirms the registration made by Users by sending a message to the e-mail address indicated by Users.

 

Upon registration, users are obliged to provide correct and up-to-date data. Users are obliged to promptly update the data provided in their registration in case of change. DOMKO shall not be held liable in case of any damages resulting from non-updated data.

By accepting these General Terms and Conditions, users give their express prior consent for the e-mail address they have indicated to be used for communication and exchange of electronic statements with DOMKO, including in the process of fulfilling orders of goods generated through the online store.

 

Goods and services for sale in the Online Shop

The goods ("Goods") and services ("Services") offered in the online shop at the time of generation of a purchase order by the User, which is indicated to be in stock with the indicated quantities, are the object of sale in the online shop.

The goods sold through the online shop are described in detail in the online shop. DOMKO shall not be held liable for possible differences in the colours of the goods purchased due to specifics in the computer screens, for the images of the products that are illustrative, for incomplete or inaccurate descriptions of the products due to the limited space and structure of the information, etc. The generation of an order for the purchase of Goods / Goods shall be deemed to be an expressed written consent by the user regarding the type, quality and quantity of the Goods / Goods added to the cart and confirmed for order and delivery through the online store.

The information about the Goods in the online shop is divided into types of groups and subgroups. On the page (link) to each item listed in the online shop, information is provided on the main characteristics of the goods and additional information aimed at helping the User make an informed choice when purchasing the product. DOMKO shall not be liable for any inaccuracies in the description of the goods which do not relate to the main characteristics of the goods and does not claim the completeness of the information provided.

 

Delivery

Deliveries are made to the address specified in the order. It is desirable that users provide an address at which the goods can be received during the period from 10:30 to 17:30 (for example, a business address). The delivery period for the Goods requested with the order is up to 5 (five) working days after receipt of order confirmation, which may be extended during public holidays and/or weekends by the period of non-working days. In all cases, there may be a delay in the delivery times indicated, for which users will be promptly notified by DOMKO. DOMKO reserves the right to extend the specified time limits by up to 7 (seven) calendar days without prior notice to users and to extend the time limits by more than 7 (seven) calendar days with the prior consent of the user who placed the order. DOMKO may request further confirmation from the user of the order placed, including by telephone and/or e-mail. In the event that the user refuses to provide the confirmation requested by DOMKO, the refusal to provide such confirmation shall result in the automatic cancellation of the order. The cost of shipping costs is automatically calculated in the order value of the online store and is indicated below the price published for the item ordered. DOMKO shall not be liable for any delay in delivery due to unforeseeable circumstances, such as a delay on the part of the courier making the delivery. Upon delivery, the goods should be carefully examined by the user. In the event of defects found upon delivery, the user shall record the type of defects found on the delivery note in the presence of the courier and notify DOMKO immediately. Upon acceptance of delivery by the Consumer without remarks by signing the bill of lading presented to him by the courier, any and all subsequent claims for defects of the goods purchased shall be deemed to be unfounded and as such shall not be satisfied. In the event that the defects found are not entered on the bill of lading in the presence of the courier upon receipt of the goods and/or the Consumer does not immediately notify DOMKO, the Consumer shall forfeit his/her right to claim. In the event of an incorrect or wrong address, contact person, and/or telephone number when generating the order, DOMKO shall not be held liable for the incorrect execution of the order as a result of the incorrect information provided by the user. In the event that the user is not found within the delivery period at the address provided by him/her and/or access to the delivery address is not provided, DOMKO shall be released from its obligation to deliver the ordered goods and the user shall lose the opportunity to have the ordered goods delivered to him/her.

Where the goods delivered clearly do not correspond to the goods requested for purchase by the user and this can be ascertained by a simple inspection of the goods delivered, the user shall be entitled to request that the goods delivered be replaced with goods corresponding to the purchase request made by him. DOMKO reserves the right to choose/change the subcontractor carrying out the delivery, without being obliged to inform the user in advance, as long as this does not affect the method and time of delivery.

 

Prices. Price reductions

On the page (link) to each item listed in the online store, information is provided on the price and applicable VAT for each item with regard to its specifics - color, size, material, etc. All prices listed on the online shop are in Bulgarian Leva and include VAT. In case the goods have several modifications, the prices for each of the modifications are indicated on its page. The merchant shall have the right to make changes to the published products, services, prices, and other characteristics of the goods at any time and without notice, and the users /legal entities shall be deemed to be informed of said changes from the date of their publication. The information on some of the published goods may not be updated, but in any case, users/entities will be notified, in the case of an order made on the e-shop with an online purchase form prior to their delivery, of any not updated information on the e-shop related to the ordered goods. Some of the information published on the e-Shop may relate to products that are not currently available or offered.

The price reductions announced by DOMKO Ltd. from time to time cannot be combined with goods from other price reductions/promotions/campaigns/promo codes, etc., and the discounts granted cannot be accumulated with other discounts. DOMKO may set recommended prices from a supplier in the online shop. DOMKO may organize promotions and campaigns that do not constitute price reductions within the meaning of the Consumer Protection Act.

 

Loyalty program

Customers have the opportunity to take advantage of the DOMKO loyalty program by registering and receiving their DOMKO card from any physical store. In this way, they will be able to save on the purchase of goods. Thanks to this card the customers receive a discount, which is determined by the amounts accumulated on the card when shopping for products in the DOMKO chain stores. The discount applies to non-promotional items and cannot be combined with other sales/promotions/campaigns/promo codes etc. Active DOMKO cards can now also be used for purchases in the Online Shop, by being digitized.
In case that customers have an issued DOMKO card, they can link it to their user profile in the Online Shop and use it both in physical DOMKO stores and for online purchases. For this purpose, it is necessary to fill in an e-mail, telephone number and card number, as well as to declare agreement with the General Terms and Conditions of the web site.
In case that they do not have a DOMKO card issued, customers have the opportunity to request its issuance through their user profile in Online Shop, and for this purpose it is necessary to fill in their first and last name, telephone number and e-mail, as well as to declare agreement with the General Terms and Conditions of the web site .
The current conditions for the discounts charged when using a DOMKO card are published at the Online Store.

 

Payment for ordered goods:

DOMKO offers the following payment methods for goods ordered through the online store:

  • Payment on delivery (cash on delivery)

If the user has chosen this payment method, they are required to pay the due amount to the courier upon receiving the goods. This amount is indicated in the order price. Certain goods marked as "prepaid items" cannot be paid for on delivery, and the user must choose one of the other payment methods available.

  • Bank transfer payment

To make a bank transfer payment, users must transfer the due amount to one of the bank accounts specified by DOMKO in the online store. During the ordering process, users should select "bank transfer payment" from the payment options menu and complete the order. The bank accounts available for payment will be displayed on the online store page. The order will be fulfilled after the payment has been received in DOMKO's bank account.

  • Payment by bank card (via a virtual POS terminal)

To make a payment by bank card, users must select "payment by bank card" from the payment options menu during the ordering process.

The bank cards with which users can make payments are: MasterCard, MasterCard Electronic, Maestro, Visa, Visa Electron, V PAY, as well as other bank cards additionally added as a payment method in the online store. Please note that your V PAY or MasterCard Electronic card will be accepted only if it is registered to participate in the Verified by Visa or MasterCard SecureCode schemes. Please also check whether your card is open by your issuer for Internet transactions.

The maximum amount that can be paid by bank card for one transaction is 10,000 (ten thousand) leva.

The security of entering and transmitting card data is ensured by using SSL protocol to encrypt the connection between the server of DOMKO and the payment page of the servicing bank.

- The authenticity of the bank card is checked by entering the security code (CVV2). -In addition, to identify the user as a cardholder, the electronic commerce payment server of the servicing bank supports the authentication schemes of the international card organizations - Verified by VISA and MasterCard SecureCode, in case users are registered to use them.

The data that the user needs to provide for payment with a bank card are as follows: -Card details (number, expiry date, 3-digit security code, cardholder name, address) -Authentication data (To identify the user as a cardholder, the electronic commerce payment server of the servicing bank supports the authentication schemes of the international card organizations - Verified by VISA and MasterCard SecureCode. In case the user is registered by their Issuing bank in these security schemes, a page will appear on the user's screen, where they need to enter their authentication password.

DOMKO does not collect or store data from the user's bank card and as a merchant does not have access to it. DOMKO is not responsible for any damages or losses incurred by the user when making payment through the electronic commerce payment server of the servicing bank.

When paying with a bank card through a virtual POS terminal, the user deposits an amount equal to the value of the order placed and only after the deposit transaction is confirmed as received by DOMKO, will the ordered goods and requested services be delivered. In the event that the user partially or fully rejects the purchased goods within a one-week period from the delivery date, if they have the right to exercise their right of refusal, DOMKO is obliged to partially or fully refund the deposited amount through a credit transaction to the bank card used for payment. If the user does not reject the purchased goods or services, DOMKO automatically accepts the made deposit as payment for the ordered goods and/or requested services.

  • Payment via ePay.bg (Borica, EUROLINE, Maestro, MasterCard, VISA, TBICredit cards)

If customers have a debit or credit card issued by a Bulgarian or international bank, they have the option to pay for their requested items through the ePay.bg system. When selecting this payment method, customers will be redirected to the ePay.bg page where they will need to enter their username and password and confirm the payment. Customers must follow all the steps to be returned to the DOMKO page for the purpose of registering their order. The order will be fulfilled after the amount is received in DOMKO's bank account.

*Attention! When requesting a particular item in the online store and it is specified that delivery will only be made after payment, this means that the item requires advance payment and cannot be delivered using the "Cash on delivery" payment option.

  • Payment via consumer credit granted by "TBI Bank" EAD

Customers can pay for their ordered items in monthly installments through consumer credit granted by "TBI Bank" EAD, under the conditions specified in the "Purchase on Installments" section and the consumer credit agreement concluded with "TBI Bank" EAD.

To pay using this method, customers need to select the "TBI credit" option from the "Payment methods" menu.

If customers wish to pay for their ordered goods in installments, they should be aware of the following:

  • Payment in installments is only possible if the total value of the ordered goods is equal to or greater than BGN 100 as the minimum total value of the order.
  • The price of the ordered goods is paid through a consumer loan granted by TBI Bank EAD.
  • For the granting of a consumer loan, delivery and payment of goods are subject to the conditions described below in the "Purchase on Installments" section and the conditions of TBI Bank EAD.
  • The granting of a consumer loan is made under the conditions and at the discretion of TBI Bank EAD, and the bank may refuse to grant the loan without providing a reason for the refusal.

Installment Purchases

Domko.com provides customers with the opportunity to purchase goods on installments from the online store through a consumer loan granted by TBI Bank EAD (the Bank) under the following conditions:

*Conditions for application:

  • Any person who has reached the age of 18, is a Bulgarian citizen or a foreign citizen who has a residence permit in the Republic of Bulgaria and a Bulgarian identity document can apply for a consumer loan;
  • The amount of the consumer loan ranges from BGN 100 to BGN 10,000;
  • The repayment period for the consumer loan ranges from 3 to 24 months;
  • Application for a loan is made online through the Domko.com online store by selecting the "TBI credit" option from the "Payment Method" section when completing the order.

*Conditions for installment purchases: If customers wish to purchase goods on installment, please note the following:

  • The total value of the ordered goods from a single order must be equal to or greater than 100 (one hundred) Bulgarian leva, regardless of the number and individual online sale price of the goods included in the order.
  • The maximum total value of goods from a single order that can be purchased in instalments is 10,000 (ten thousand) Bulgarian leva. It is not possible to purchase only part of the goods in a given order on instalments - if the "TBI credit" option is selected from the "Payment Method", it always applies to all goods in the given order.
  • You must apply to the Bank for a consumer loan and the Bank must approve the loan.
  • Applying for a consumer loan to pay for a specific order is done online through the online store, with the Customer selecting the "TBI credit" option from the "Payment Method" when completing the order. The Customer must choose a repayment period for the goods (from the possible options generated by the credit calculator based on the final value of the order), fill in the required data in the fields that open when selecting this option, and click the "Complete order" button.

Customers can purchase goods on installment and apply for a consumer loan, both through their registered user profile and without registering on the online store - as a guest.

  • After the order is completed, a bank employee will contact the user. The approval and disbursement of the loan are carried out entirely remotely by a bank employee under the conditions and procedures of the bank. Users are requested to follow the instructions they receive. At every stage of the procedure, a bank employee will send a message or contact the user.
  • Attention! DOMKO does not send messages and cannot provide information to users regarding the status and outcome of the consumer credit disbursement procedure, only regarding the status and execution of the order, and is not responsible in case the bank refuses to provide consumer credit.
  • The ordered goods are delivered to the user only after the bank approves the disbursement of the consumer credit and the user signs the necessary documents required by the bank. The delivery period starts after the bank notifies DOMKO that the consumer credit has been granted to the user, covering the full price of the goods ordered from the respective order.
  • In the event that the bank does not approve the disbursement of the consumer credit, the order is automatically considered refused, and DOMKO has no obligations regarding its execution, and the relationship between DOMKO and the user regarding this specific order is terminated, for which DOMKO notifies the user at the email address provided by the user. The user can reorder the same goods by choosing another method of payment.
  • In case of cancellation, termination, or dissolution of the purchase agreement for goods purchased on installment with a consumer loan, by accepting these General Terms and Conditions, the Consumer expressly agrees and instructs DOMKO to transfer the price of the purchased goods directly to the Bank instead of returning it to the Consumer. The transfer is made after the Consumer returns the purchased goods to DOMKO in the form, conditions, and deadlines specified in the "Cancellation and Replacement" section. The Consumer declares that by transferring the amounts to the Bank, they will have no claims against DOMKO regarding the price of the purchased goods on installment and their return. The Consumer solely settles and deals with the Bank on all matters related to the consumer loan agreement.

Conditions for granting consumer credit by the Bank:

  • All conditions and procedures related to the provision of consumer credit (conditions for application, approval criteria and procedure, repayment period, number and amount of installments, interest and fees on the loan, settlement of relationships in case of default and non-performance on the loan, etc.) are determined unilaterally solely by "TBI Bank" EAD;
  • The conditions of the consumer credit (principal, interest, fees, term, installment amount, APR, etc.) stated on the Online Store are predetermined by the Bank and cannot be changed by DOMKO, nor can they be subject to negotiation between DOMKO and the Consumer;
  • DOMKO does not participate in any way in the financing of the consumer credit, nor in any of the relationships that arise between the Consumer and the Bank in connection with the financing, including but not limited to determining the conditions for applying for a loan, approving or rejecting the loan, determining the conditions and term of the loan agreement, in case of non-performance - taking the actions provided by law related to enforcement, etc;
  • DOMKO is not a party to the consumer credit agreement. The Consumer enters into a consumer credit agreement solely with the Bank, and all relationships related to the conclusion, execution, and non-performance of the consumer credit agreement are fully and solely regulated between the Consumer and the Bank.

Consumers declare that they are aware that for the purpose of applying for a consumer loan, they will provide their personal data, which will be processed by the Bank as a data controller in accordance with the Bank's privacy policy. Consumers can familiarize themselves in more detail with the privacy policy of DOMKO and the Bank.

 

Complaints. Commercial guarantee.

Complaints can be made for goods that do not meet the quality requirements specified on the electronic store and/or in accompanying certificates and instructions for use, if any have been issued for the respective goods, as well as for those that contain obvious defects upon delivery to the consumer. Differences in color shades are not considered a defect and cannot be a basis for returning the product. Therefore, upon delivery, the consumer must mark any obvious defects and/or discrepancies in quantity on the delivery note. Otherwise, it is considered that the quantity of goods corresponds to the ordered one and the order has been executed accurately.

Outside of cases related to discrepancies in quantity, complaints about purchased and delivered goods can be submitted within 30 (thirty) days from the date of delivery.

DOMKO is responsible for any non-conformity of the consumer goods with the sales contract, which exists at the time of delivery and manifests itself within two years of its provision, but no later than 14 days from the establishment of the non-conformity according to the Consumer Protection Act.

A commercial warranty is any obligation assumed by DOMKO or the manufacturer (guarantor) towards the Consumer, in addition to its legal obligation to ensure compliance of the product with the sales contract, with the aim of refunding the amount paid or replacing or repairing the product, or providing another type of service related to the product when it does not meet the specifications or other requirements unrelated to compliance of the product with the sales contract, as indicated in the warranty statement or relevant advertisement made at the time of or before concluding the contract. The commercial warranty is an independent obligation assumed by the manufacturer and/or the merchant and does not affect the rights that Consumers have under the provisions of the Law on Protection of Consumers. The commercial warranty is only applicable if the conditions described in the warranty card or other document are met.

 

Intellectual property rights

The content, logos, any graphic images or text, trademarks, dynamic symbols, text and/or multimedia content of the Online Store are exclusive property or granted for use by the manufacturers of DOMKO for the purposes of selling their products. Users may use all services offered by the Online Store provided that they do not infringe on the copyright of DOMKO or third parties directly or indirectly related to the materials of the Online Store. It is expressly forbidden for users to copy, modify, and/or publicly distribute the materials published on the Online Store for any purpose. When purchasing products subject to copyright and/or patent rights, DOMKO does not provide any additional rights for use and distribution, except for the explicitly stated rights and/or licenses from the manufacturer/distributor of the products. All products and services provided by DOMKO, which are protected under the Law on Copyright and Related Rights, are provided to users in their original form and packaging without any interference from DOMKO. Users are not allowed to copy, distribute, publish, provide to third parties, modify in any way any part of the content of the trademarks, logos, multimedia content of the Online Store, or descriptions of products or services. Users are also not allowed to transfer, sell or distribute materials created through reproduction (copying), modification or publication of the content on the Online Store.

 

Cancellation of purchased goods

Consumers, if they have consumer status as defined in Paragraph 13, item 1 of the Supplementary Provisions to the Consumer Protection Act - any natural person who acquires goods or uses services that are not intended for commercial or professional activity, and any natural person who, as a party to a contract within the meaning of the Consumer Protection Act, acts outside the scope of their commercial or professional activity, have the right, without owing compensation or penalty and without stating a reason, to withdraw from the contract within a period of 14 (fourteen) days from the date on which the Consumer or a third party other than the carrier and indicated by the Consumer has taken possession of the goods.

DOMKO guarantees the quality of all its products. If, however, they do not meet the requirements of the Consumers, Consumers have the right to refuse one or more items from the placed order within 14 days of receiving it, by first notifying DOMKO about it. The notification of refusal is carried out by the Consumers using the contact form located on the Electronic Store.

Detailed information about the conditions for cancellation is described in the Return and Exchange Policy.

To exercise their right to cancel, the User should notify DOMKO of their name, geographical address, order number, and if available, their phone number, email address, and their decision to withdraw from the contract with an unequivocal statement (e.g., a letter sent by post or email). The User may use the standard form for cancellation of an order, available with each order or in the Online Store, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for the User to send their communication concerning the exercise of the right to cancel before the cancellation period has expired.

The User may return the goods at the expense of DOMKO, using a Speedy courier by selecting this option when completing the return request, or may use another method of delivery at their own expense, specifying this in the return request.

Users are obliged to store the products properly while they are in their possession, as well as when they return them, to avoid damage or loss during transportation. Users are required to keep the note from the post or courier company that delivered the shipment as evidence that their package has been sent. Otherwise, Users assume the risk of losing the goods before we receive them.

When returning goods, customers must comply with the following conditions:

  • When returning rejected goods, it must be accompanied by proof of purchase (invoice and receipt) and a copy of the Return Request (generated by filling out the form on the website), unused, unopened, and in a preserved commercial appearance, with the original packaging preserved, addressed to our correspondence address: Sofia, Okolovrasten road № 145;
  • For hygiene reasons, bedding, blankets, pillows, lightweight quilts, towels, and robes with an open package cannot be refused or returned unless it is the customer's right to return them, i.e., only when a defect is identified and confirmed by DOMKO;
  • Articles made or delivered to order and personalized products cannot be returned or replaced, and the customer is responsible for the accuracy of the submitted sizes. This does not apply in cases where the product with non-standard sizes has a defect;

The refund of the amount for a rejected item(s) after confirmation by a DOMKO employee that the returned goods meet the above criteria is made by bank transfer to the bank account specified by the customers in the Return Request.

We do not refund the amount for items returned after the 14th day of receipt, damaged, used items, or those with damaged packaging. In these cases, we will return the items back to the customers at their own expense.

The purchase refusal policy does not violate the consumer rights of customers in cases of defective/damaged goods.

In the event that the User withdraws from the contract, DOMKO will refund all payments for the goods received without undue delay and in any case no later than 14 (fourteen) days from the date on which the returned goods were received by DOMKO.

By accepting these general terms and conditions, the consumer expressly agrees that the refund of the amount paid by him/her will be made to the bank account provided by him/her.

DOMKO has the right to delay the refund until the goods are returned or until evidence is provided that the goods have been sent back, whichever event occurs earlier.

The consumer must send or return the goods to DOMKO without undue delay and in any event no later than 14 (fourteen) days after the day on which he/she informed DOMKO of his/her decision to cancel the contract. The deadline is considered met if the consumer sends the goods back to DOMKO before the 14-day period expires.

The goods must be returned in their original packaging, complete set with accompanying documentation and without damage, in the form in which they were received. DOMKO reserves the right, in the event that the returned goods have damaged packaging, signs of use, scratches, impacts, or missing accessories, warranty card, to assess whether to accept the returned goods.

The consumer is responsible for the reduction in value of the goods resulting from their handling, other than what is necessary to establish their nature, characteristics and functioning. Any testing of the goods that is different from what is necessary for normal and reasonable testing in a commercial establishment is considered to be testing in a manner other than necessary.

When DOMKO has not fulfilled its obligations to provide information, as defined in Article 54 of the Consumer Protection Act, the consumer has the right to cancel the contract within three months from the date of receipt of the goods. When the information under this paragraph is provided to the consumer within the cancellation period, the same period begins to run from the date of providing the information.    The consumer is obliged to keep the goods received from DOMKO, their quality, and safety during the period in which the right of withdrawal can be exercised.

The right of withdrawal from certain types of purchased goods can be exercised in accordance with the provisions of Articles 50-56 of the Consumer Protection Act. The right of withdrawal from distance contracts or contracts outside commercial premises does not apply to contracts:

The consumer is obliged to store the goods received from DOMKO, their quality and safety during the period in which the right of withdrawal can be exercised.

The right of withdrawal for certain types of purchased goods can be exercised in accordance with the provisions of Articles 50-56 of the Consumer Protection Act. However, the right of withdrawal does not apply to contracts:

  • for the provision of services where the service has been fully provided, where the contract provides for an obligation for the consumer to pay, and performance has begun with the express prior consent and confirmation of the consumer that they know that they will lose their right of withdrawal once the contract has been fully performed by DOMKO;
  • for the supply of goods or services whose price depends on fluctuations in the financial market which cannot be controlled by DOMKO and which may occur during the period for exercising the right of withdrawal;
  • for the supply of goods made to the consumer's specifications or clearly personalized;
  • for the supply of goods which by their nature are liable to deteriorate or expire rapidly;
  • for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
  • for the supply of goods which, after delivery, are, by their nature, inseparably mixed with other items.
  • "For the delivery of goods, in cases where the Consumer has expressly requested DOMKO to visit their home for urgent repair or maintenance activities, when DOMKO provides other services in addition to those requested by the Consumer, or delivers goods other than spare parts required for the repair or maintenance, the right of refusal applies to these additional services or goods.
  • When the Consumer exercises their right of withdrawal from the distance contract or the off-premises contract, any additional contract is automatically terminated without the Consumer owing any costs, compensation and/or penalties, except for the costs provided for in the Consumer Protection Act. This does not apply to Article 28 of the Consumer Credit Act.
  • When returning the Goods for which the right of withdrawal has been exercised, they must be accompanied by proof of purchase (invoice and receipt) and a withdrawal form (provided together with the shipment), unused, unopened and in a preserved commercial appearance, with the original packaging preserved, addressed to DOMKO's correspondence address: 145 Okolovrasten pat Str., Sofia, Bulgaria.
  • The right of withdrawal does not apply to the following types of Goods for hygiene reasons: bedding, blankets, pillows, lightweight duvets, towels, and robes with open packaging and similar."

 

Rights and Obligations of Consumers

Consumers have the right to browse, order, and receive Goods from the Online Store according to the terms and conditions specified therein.

Consumers have the right to be informed about the status of their Order.

Consumers have the right to receive delivery of the requested Goods at the specified delivery address, after confirmation by phone by a representative of the Online Store.

Consumers are fully responsible for safeguarding their username and password, as well as for all actions taken through their account or when provided for use by third parties. Consumers are obliged to immediately notify the Online Store of any case of unauthorized access using their username and password, as well as whenever there is a risk of such use.

Consumers are obliged to pay the price of the ordered Goods and the delivery price according to the announced method in the Online Store.

Every Consumer, whether they have made an Order or not, is obliged to when using the Online Store:

  • Not to violate and to respect the rights and freedoms of citizens, in accordance with the Constitution, the laws of the Republic of Bulgaria and international acts to which it is a party, the rules of morality, good manners, and Internet ethics;
  • Not to violate the property or non-property, absolute or relative rights and interests of others, such as the right to property, intellectual property rights, etc.;
  • Not to carry out malicious actions.

 

Rights and obligations of DOMKO

DOMKO has the right, but not the obligation, to retain materials and information used/located on the server of the Electronic Store or made available to third parties by the User, and to provide them to third parties and the relevant state authorities in cases where it is necessary to preserve the rights and legitimate interests, property, and security of the Electronic Store, as well as of third parties, in cases of claims for infringement of their rights regarding the use or dissemination of information or materials, as well as in cases where the materials or information are required by state authorities, under an express legal provision.

DOMKO has the right, at any time, without notifying Users, when the latter use the Electronic Store in violation of these terms and conditions, as well as at the discretion of DOMKO, to terminate Users' access to the Electronic Store. DOMKO is not responsible for any damages or losses suffered by Users and third parties resulting from the termination, suspension, modification, or restriction of access, deletion, modification, loss, inaccuracy, or incompleteness of messages, materials or information transmitted, used, recorded, or made available through the DOMKO Electronic Store.

DOMKO can provide publication in the thematic sections of the Electronic Store of links to other websites and resources. DOMKO is not responsible for any damages and losses incurred in connection with the use, access, or accuracy of these materials and content. Users are fully responsible for any damages caused to DOMKO and third parties as a result of their use or access to these websites and resources.

Users are obliged to compensate DOMKO and all third parties for any damages and losses, including any expenses and paid legal fees, incurred as a result of claims and/or paid compensations to third parties in connection with the Electronic Store, hyperlinks, materials or information that Users have used, placed on DOMKO's server, sent, distributed, made available to third parties or made accessible through DOMKO in violation of the law, these General Terms and Conditions, good morals, or Internet ethics.

DOMKO has the right at any time to send system messages related to changes in the terms of purchase, new features, news, and other services. DOMKO has the right to send an electronic newsletter with news to users of the Electronic Store if they have confirmed their consent to receive it. This electronic newsletter contains current promotions, new products, news about upcoming holidays, fresh gift ideas, and more.

 

Data Protection. Confidentiality.

DOMKO takes technical and organizational measures to protect the personal data of users in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), the Law on the Protection of Personal Data, and all applicable legal acts in the field of personal data protection.

DOMKO is a data controller, in accordance with Article 4(7) of Regulation (EU) 2016/679, established in the territory of the Republic of Bulgaria and lawfully and fairly processes personal data in connection with the purposes of its activity - wholesale and retail trade - and does not process them further in a way incompatible with those purposes. When performing certain activities on behalf of its partners, DOMKO may act as a data processor within the meaning of Article 4(8) of Regulation (EU) 2016/679, and these relationships are governed by an agreement under Article 28(3) of Regulation (EU) 2016/679.

DOMKO processes personal data while complying with the basic principles of data protection and having at least one of the grounds for lawful processing, in accordance with Regulation (EU) 2016/679. DOMKO relies on consent for processing personal data when there is no other legal basis stated in Article 6 of Regulation (EU) 2016/679. DOMKO processes personal data for the stated purposes or when the individual to whom the data relates has explicitly given their consent.

DOMKO does not process personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as genetic data, biometric data for the sole purpose of identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation - User of the Electronic Store.

When DOMKO has reasonable doubts about the identity of the User with whom they are exchanging information containing personal data, DOMKO may request additional information necessary to confirm the identity of the User, including when exercising rights under Articles 15-22 of Regulation (EU) 2016/679.

In the event that the User has forgotten or lost their password to access their user profile, they can recover it by following the steps in the Electronic Store.

The personal data provided by the User, as well as the personal data obtained by DOMKO in the process of providing the services of the Online store, are processed and stored by DOMKO in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament) and the Personal Data Protection Act.

Detailed information on the purposes and legal basis for processing personal data; the categories of recipients of personal data; the duration for which personal data will be stored; the rights of data subjects in relation to the processing of their personal data by DOMKO, as well as information on how they can be exercised; contact details for the data protection officer; and any other information required by the General Data Protection Regulation to be provided to Users, is contained in DOMKO's Privacy Policy, which is published on the Online store.

 

Cookie Policy

In order to improve the efficiency of the Electronic Store, it uses data files called "cookies". Processing and storing of cookie data is carried out in accordance with the provisions of the General Data Protection Regulation and the Cookie Policy of DOMKO, which is published on the Electronic Store.

 

Changes to the General Terms and Conditions

DOMKO reserves the right to update the General Terms and Conditions of the Electronic Store periodically to reflect any changes in the way the Electronic Store operates and the conditions or any changes in legal requirements. The changes take effect from the moment of their publication on the Electronic Store. For each purchase of goods through the Electronic Store, the general terms and conditions that were in force at the time the order was generated apply.

In the event that users do not agree to the amended general terms and conditions, DOMKO has the right to refuse to provide services to those users of the Electronic Store. A necessary condition for purchasing goods through the Electronic Store is the agreement of the users with the general terms and conditions and the privacy policy upon completion of the order.

If any of the provisions of these general terms and conditions for using the Electronic Store are found to be invalid or unenforceable, regardless of the reason for this, it does not invalidate or render unenforceable the other provisions, and the invalid provision is replaced with one that is valid under the law.

 

Messages:

Unless otherwise specified, all messages related to the status of orders and delivery of Goods through the Online Store are carried out on the phones/contact addresses announced in a visible place on the Online Store and respectively on the specified phones/contact address of the Users, including email. Users can receive information about the status of their orders at any time from the "My orders" section, with a registered user profile or on the phones in the Online Store. All messages sent in the above-mentioned way will be deemed duly received until proven otherwise.

All disputes between the parties to these general terms and conditions may be resolved by the competent court applying the current legislation.
